Garden System is a trading style of Eastern Counties Pumps Ltd
These do not affect your statutory rights but are for yours
and our protection.
All products have a one year guarantee against manufactures
faults. Please note that in some cases these are conditional.
If the items are not to your satisfaction, for any reason,
please return them to us in their original condition for a
full refund. When returning items please ensure you obtain
a certificate of postage and include your name and address.
Garden Systems are not responsible for returned items that
fail to arrive at our premises.
It is the customers responsibility to ensure all products
are installed correctly, watering products are protected from
frost, water pumps are never run with their inlets or outlets
blocked or with no water in them. Controllers and timers are
not covered against lightning strikes and frost damage.
Greenhouse heaters are covered for a period of one year from
purchase against manufactures faults. For most Bio Green products,
this is extended for a further two years on all components
providing the heater has been serviced by a qualified engineer
annually. Please note that blocked nozzles are not covered
by a guarantee, care should be taken when changing a gas bottle
that dirt or debris is not introduced. We advise that all
electrical appliances be checked annually by a qualified electrician.
All drip watering products are designed to be used with clean
water. Garden Systems are not responsible for products blocked
by contamination including natural water deposits.
All advice given by Garden Systems, its employees and agents
verbally and in writing is given in good faith on the information
provided by the customer, we cannot be held liable for the
consequences.
Garden Systems are not liable for the installation costs
of any of the equipment and if making arrangements for third
parties to install the equipment we strongly recommend that
no arrangements are made until the equipment arrives and is
checked to be in good working order. Garden systems cannot
be held liable for consequential loss or expense in late arrival
or faulty goods.
We have tried to give an accurate size, specification and
colour representation but all are approximate. All prices,
specifications and goods availability are subject to change
and on ordering you will be notified of any alterations from
our most recent catalogue.
In the following standard conditions of sale, GS means Eastern Counties Pumps Ltd, trading as Garden Systems, 103 Burrell Road,
Ipswich, IP2 8AD.
1.GS accepts liability for death or personal injury to the
extent that it results from the negligence of GS, its employees
or its agents.
2. If the equipment or any part of the equipment or its fittings
(‘the Goods’) are found to be defective GS agrees
to replace free of charge or refund the cost of the goods
which are found to be defective and which are returned to
GS within twelve months from the date of purchase provided
that each of the following is satisfied:
(i) the customer notifies GS of any defect immediately once
it becomes apparent to the customer;
(ii) the goods have only been operated under normal operating
conditions and have only been subject to normal use;
(iii) no work whatsoever (other than normal and proper maintenance)
has been carried out to the goods without GS’ prior
written consent;
(iv) the goods have been used in accordance with the manufacturer’s
or GS’ instructions;
(v) the defect has not arisen from a design made, furnished
or specified by the customer;
(vi) the defect has not arisen from a design modified by
the customer.
3. Subject to conditions 1 and 2, GS shall not be responsible
or liable for any defect in the goods.
4. Subject to clause 1 GS will not be responsible or liable
for any injury, death, loss or damage whatsoever consequential
economic or otherwise directly or indirectly caused by any
backflow or back siphonage of water or directly or indirectly
caused by or to the goods. GS will not be liable for any loss
of profits or other economic loss
5. GS gives no condition or warranty or other terms express
or implied (by statute or otherwise) that use of the goods
will comply with any statute statutory instrument bye-laws
or regulations. The customer shall be responsible for consulting
their local Water Authority on compliance with any statute
statutory instrument bye-laws or regulations in relation to
any use of the goods or to any connection installation or
incorporation of the goods to any tap, check valve, pump,
air gap, pipe interrupter or vacuum breaker. GS will not be
liable for any action whatsoever brought for any alleged contravention
of any statute statutory instrument byelaws or regulations.
6. If the customer deals as a consumer in relation to GS
these standard conditions of sale will not affect the customer’s
statutory rights. In this clause the words ‘deal as
a consumer’ shall mean that the customer does not buy
or hold himself out to buy the goods in the course of business.
